Regulations of Home Visits by Prisoners for the Open Prison

  1. Prisoners of this prison who have demonstrated good behavior without posing risks to public order or social security, and who meet the following requirements, may apply for home visits on holidays or memorial days:
    • Have achieved work performance of at least 80% of the legal maximum for two consecutive months during their time at the open prison.
    • Have not received punishment under Article 86, Paragraph 1 of the Prison Act in the two months prior to application.
    • Have not violated the home visit compliance matters stated in Article 11, Paragraphs 2 and 5 in the two months prior to application.
    • Have no other circumstances indicating risk of escape or harm to social security during the home visit period.
  2. Frequency of home visits Old law (for those entering this prison before February 2024):
    • Once per month for sentences less than three years.
    • Once every two months for sentences between three and seven years. However, those who advance to Level 2 or above in progressive treatment may visit once per month.
    • Once every three months for sentences exceeding seven years but less than fifteen years with Level 3 progressive treatment. However, those who advance to Level 2 may visit once every two months; those advancing to Level 1 may visit once per month.
    • Once every three months for sentences of fifteen years or more with Level 2 progressive treatment. However, those who advance to Level 1 may visit once every two months.
    • Once every three months for life imprisonment.
    • Prisoners aged 65 or above may apply for home visits once per month, regardless of restrictions in points 2 through 4.
      New law (for those entering this prison after February 2024):
    • Once every three months for those serving less than six months in open prison.
    • Once every two months for those serving between six months and one year in open prison.
    • Once per month for those serving more than one year in open prison.
    • Prisoners aged 65 or above may apply for home visits once per month, regardless of restrictions in points 1 through 3.
  3. Family cooperation matters
    • Must include family consent form and household registration transcript of the home visit recipient.
    • Family members should record the prisoner's living conditions and arrival/departure times during the home visit period in the contact book.
  4. Activity range is limited to the boundaries of the application location (municipality, county, or city).
  5. Those who fail to return to prison within the designated period without legitimate reason will not have external days counted as execution days and will be charged with escape.
